Hon’ble High Court of Delhi has ruled, under their judgment dated 20.11.2008 in case of discharge of Low Medical Category (LMC) of Sub (SKT) Puttan Lal and others connected case, that a permanent Low Medical Category (LMC) person can only be discharged by putting him through an Invaliding Medical Board (IMB). For implementation of above court order AG Branch of Integrated HQ of M.O.D. (Army) has decided to reinstate the persons of Low Medical Category discharged without putting them through Invaliding Medical Board (IMB). Accordingly, the P.P.Os notifying the pensionary awards in respect of individual discharged under Low Medical Category (LMC) and have now been reinstated in terms of Hon’ble High Court judgment dated 20.11.2008, are needed to be cancelled by this office.
However, it has been reported by various Record Offices that various pension disbursing authorities are not returning the original copy of P.P.O. on asking for the same by them.
In view of above, it is requested that the paying branches/Offices, Treasury under your jurisdiction may be instructed to return the original P.P.O. to the concerned Record Offices at the earliest when they request for the same so that Hon’ble Court judgment be implemented within stipulated period. They may further be instructed to furnish a certificate to the effect that payment of pension has been stopped by them.
