Maternity Leave and Pension Ministry of Personnel, Public Grievances & Pensions Maternity Leave and Pension 21 MAR 2018 Hon’ble Delhi High Court vide its judgement dated 17.07.2015 in the Writ Petition (C) No. 844/2014 - Rama Pandey vs. Union of India &Ors., has laid down that a female employee, who is the commissioning mother, would be entitled to apply for maternity leave. Department of Personnel and Training, after examination of the judgement, has circulated it to all Ministries/Departments for wide publicity vide Office Memorandum dated 29.01.2018. In accordance with the Office Memorandum No. 1/13/09- P&PW (E) dated 19th July, 2017, family pension would also be granted to a divorced daughter from the date of divorce in cases where the divorce proceedings had been filed in a competent court during the life-time of the employee/pensioner or his/her spouse but divorce took place after their death, subject to fulfilment of all other conditions for grant of family pension. Benefits of Pay Commission to ex servicemen – Rajya Sabha Q&A GOVERNMENT OF INDIA MINISTRY OF DEFENCE RAJYA SABHA QUESTION NO 2580 ANSWERED ON 19.03.2018 Benefits of Pay Commission to ex servicemen 2580 Shri Mahendra Singh Mahra Will the Minister of DEFENCE be pleased to state :- (a) the total number of reserve ex-servicemen being given pension after ten years of service; (b) whether they also got the benefit of pension hike and allowances like other pensioners; (c) if so, whether they have also been given the benefit of recommendations of 4th, 5th and 6th Pay Commissions constituted by Government and if so, the details thereof and if not, the reasons therefor; (d) whether these reserve soldiers come under the category of ex-servicemen; and (e) if so, the details of reasons for keeping them deprived of benefits of Pay Commissions as extended to the ex-servicemen? ANSWER MINISTER OF STATE IN THE MINISTRY OF DEFENCE DR. SUBHASH BHAMRE (a) to (c): A reservist who is not in receipt of service pension is granted, on completion of the prescribed combined colour and reserve qualifying service of not less than 15 years, a reservist pension equal to 2/3rd of the lowest pension admissible to a Sepoy. Reservist pension is linked to lowest pension admissible to a Sepoy as such the hike in pension of Sepoy in various Pay Commissions is also passed on to Reservist pensioners. Further, the rates of minimum Reservist pension had been revised in various Central Pay Commissions (CPCs) as under:- (i) Rs.375/- w.e.f. 1.1.1986 in 4th CPC, (ii) Rs.1275/- w.e.f. 1.1.1996 in 5th CPC, (iii) Rs.3500/- w.e.f. 1.1.2006 in 6th CPC and (iv) Rs.9000/- w.e.f. 1.1.2016 in 7th CPC. Dearness Relief as applicable from time to time is also admissible on Reservist pension. Indian Railways has come out with a policy to ensure a fair, transparent and competitive recruitment process that follows the law and the guidelines laid down by Hon’ble Supreme Court. We have already reserved 20% posts for ‘Course Completed Act Apprentices’ who were engaged in Railway establishments under the Apprenticeship Act. This has been done as per Section 22(1) of the Apprentices Act and the various judgements pronounced by the Hon’ble Supreme Court from time to time. Applicants who completed the Apprenticeship course have also been given an age relaxation equal to the period of apprenticeship. This is the single largest recruitment ever undertaken by any organisation in India and also the largest opportunity for all sections of youth, including the apprentices to join the Indian Railway in a very transparent and fair manner. Moreover, it has been observed that they do not forward the same to their CPPCs, resulting in stoppage of pension/ family pension which causes undue financial hardship to the pensioners/ family pensioners. In view of the above, Heads of CPPCs and Heads of Government Business Divisions of all the authorized banks are requested to issue necessary instructions to all their branches to provide the acknowledgement of Life Certificate to the pensioner/ family pensioner without fail and forward the same to the concerned CPPCs for necessary action. Sub: Payment of Dearness Allowance to Railway employees — Revised rates effective from 01.07.2013.
Please refer to this Ministry’s letter of even number dated 26.04.2013 (S.No PC-VI/315, RBE No.38/2013) on the subject mentioned above. The President is pleased to decide that the Dearness Allowance payable to Railway employees shall be enhanced from the existing rate of 80% to 90% with effect from 1st July, 2013.
2. The provisions contained in Paras 3, 4 & 5 of this Ministry’s letter of even number dated 09.09.2008 (S.No.PC-VI/3, RBE No.106/2008) shall continue to be applicable while regulating Dearness Allowance under these orders.
3. The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all railway employees. The arrears may be charged to the salary bill and no honorarium is payable for preparing separate bill for this purpose.
4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.
